The opinion of the court was delivered by This was an action for damages for personal injuries sustained
in an automobile collision. Plaintiff (appellant) was riding in
the front seat of a DeSoto sedan owned and driven by his neighbor
Joe Blackburn when it collided with the rear of a Mercury sedan
owned and driven by the defendant (appellee); both cars were
traveling in the same direction. The jury returned a general
verdict for the defendant and made special findings hereinafter
detailed. On October 15, 1955, plaintiff and his family and other friends
gathered at the farm home of Charles "Dude" Blackburn, a neighbor
of rural Parsons, for a fish fry. About 6:45 P.M. plaintiff
announced he was out of cigarettes and suggested they go to
Parsons to get some. Plaintiff's car was first in the driveway,
